Bill C-28

Here are some explanations about Bill C-28 as well as the law in force in the United States 

 

A new law (C-28) is now adopted in Canada in respect of privacy for electronic communcations.

In summary: 

The mailing address at the bottom of consignments is required 

An unsubscribe link is required. 

 

Here are some excerpts for your use: 

[...] There may be sent to an electronic address a commercial electronic message to be sent to or permit to be sent unless 

             a) the person to whom the message is sent has expressly or tacitly consented to receive it; 

 

(2) The message must comply with the regulatory requirements relating to the form and include both: 

             a) the prescribed information identifying the person who sent it and, if applicable, the name of which he was sent; 

             b) information enabling the person who received it to communicate easily with one or other of visées1 people. 

 

(1) The exclusion mechanism referred to in paragraph 6 (2) c) must meet the following requirements: 

  a) allow the person receiving the e-mail message to express, using the method used to send the message, it will not receive any further commercial electronic messages - or certain categories thereof - of the person who sent or, where applicable, that the name of which he was sent; 

  b) provide the email address to which the person may communicate his will or link to use to do this. 

  c) (3) The person who sent the message and, if applicable, the name of which he was sent are required to ensure that effect is given to the wishes of the person who received promptly and in any event no later than ten days after such determination has been notified to the address referred to in paragraph (1) b) or through the link mentioned in this paragraph and without requiring any further action by the person who received the message.
